SIMPLY TYRES is a mobile tyre fitting service based in Leicester, that provides tyre services to customers across the Leicestershire

All the terms and conditions that are stated on this page govern the relationship between the company SIMPLY TYRES and their customers.

Henceforward,

“We” or “Our” refers to SIMPLY TYRES.

“Our site” or “Our website” refers to the company website www.simplytyres.co.uk owned and controlled by SIMPLY TYRES.

“You” refers to our customers and visitors/users of our website.

Please go through the terms and conditions mentioned on this page thoroughly:

PLEASE NOTE: All bookings are taken unless otherwise agreed in writing on a "standard appointment" basis. This means that we will attend and change a tyre/s using standard tools and equipment. The wheel should be in a serviced condition, wheel nuts should be at a torque advised by the manufacturer and all equipment needed in the tyre change such as locking wheel nut key should be present. Should any additional equipment be required or the appointment be anything other than a "standard appointment" you will be informed by the technician at the earliest opportunity and the below terms will be applied.

1. Online price and transactions

The price of the all the products and services that we render is in pounds, with the cost of labour and part, and VAT included.

Online prices are only available when you purchase through our website www.simplytyres.co.uk and do not represent prices or quotations issued by our staff or representatives. We are within our rights to postpone or cancel the order, even after providing an order confirmation to you, if we are unable to fulfil that order. We may be unable to fulfil that order if the purchased product is out of stock or the information about the purchased product/service is found to be incorrect. In this case, we will contact you and offer an equivalent product/ reschedule the cancelled appointment. If we fail to find an agreement over the new offer, then you may cancel the order and claim a full refund. We are not accountable for any loss that results from the delay in processing your order or its cancellation. We are only liable to refund the customer for the cancelled order.

2. Incorrect orders

It is only your responsibility to make sure that the tyres you buy from our website meet your vehicle's specifications. We are not liable for any damage caused by your order of tyres with incorrect dimensions from our website. You should always check the tyre size manually which is present on all of your vehicles' tyre sidewalls or in your owners' handbook.

We cannot be held responsible for incorrect orders which use the registration checker on our website. This is only a guide and is supplied by a third party from OEM data and its accuracy cannot be guaranteed.

In these circumstances no refund will be due and we reserve the right to withhold 100% of the order value plus the call out charge for your area.

In certain circumstances and at our discretion, we may offer to rebook your appointment at a cost of £45 plus the call out charge for your area. If we have ordered a tyre from our suppliers to fulfil your appointment £39.99 per tyre will also be deducted from your order value to return the tyre to our supplier.

In this circumstance, we will calculate the price of the correct tyre/s plus any charges and inform you of the costs to allow you to make an informed decision to rebook or not.

3. Returns/Faulty Goods

We shall not accept returns, nor provide refunds for tyres already fitted to your vehicle. If you find the tyre to be defective after being fitted, you may buy a replacement product from us as we send the defective product to the manufacturer for assessment. If the product is confirmed faulty by the manufacturer, then we shall refund the cost of the replacement component in full. We are only liable to refund you for the purchase of the faulty component.

4. Missed appointments (Attended)

A) If we attend and are unable to complete the agreed work due to no-one being at the agreed location during the appointment time period or the vehicle not being at the agreed location, the appointment will be deemed a missed appointment. No refund will be due and we reserve the right to withhold 100% of the order value plus the call out charge for your area. 

B) If we attend and are unable to complete the agreed work due to mechanical issues, the absence of locking wheel nuts or for any reason out of our control, the appointment will be deemed a missed appointment. No refund will be due and we reserve the right to withhold 100% of the order value plus the call out charge for your area. 

In certain circumstances, there may be additional services we can offer to resolve the issue. These are at the discretion of the technician who will assess the situation and advise you of the costs involved. If these additional services are declined we reserve the right to withhold 100% of the order value plus the call out charge for your area. These services will be subject to the availability of the necessary equipment and time available. We are not obliged to offer any additional services at any time.

Should we attend your vehicle and any other tyre, other than the tyre booked be deemed unroadworthy or illegal we reserve the right to refuse to fit any tyres to your vehicle. In these circumstances you will be supplied with the tyre that you have ordered and no refunds will be due. You may be offered the opportunity to purchase additional tyres to ensure your vehicle is legal/roadworthy (time and stock availability dependent) and additional costs will be fully explained to you. The technicians decision is final.

Should the technician need to collect additional tyres or equipment in these circumstances an addition £39.99 will be added to the cost to cover fuel, time and labour.

5. Cancellations/Reschedules

You can cancel and reschedule your appointment, subject to our availability, to a later date. 

For online order cancellation, cancellation must be made 72hrs before the date of the appointment for you to be eligible to claim a full refund.

After this time cancellations may be accepted but will be subject to a refund of only 25% of the order value (not including call out charge for your area)

If we have ordered a tyre from our suppliers to fulfil your appointment £39.99 per tyre will also be deducted from your order value to return the tyre to our supplier.

Cancellations of same day bookings (non emergency) made via the telephone, once accepted by us will be subject to a refund of only 25% of the order value (not including call out charge for your area)

If we have ordered a tyre from our suppliers to fulfil your appointment £39.99 per tyre will also be deducted from your order value to return the tyre to our supplier.

Any booking made over the telephone which are not a same day booking will also be subject to the 72hr cancellation period. After this time cancellations may be accepted but will be subject to a refund of only 25% of the order value (not including call out charge for your area)

If we have ordered a tyre from our suppliers to fulfil your appointment £39.99 per tyre will also be deducted from your order value to return the tyre to our supplier.

Emergency and Evening Call Outs are non refundable under any circumstances once the booking has been accepted and payment made.

6. Estimates

The cost estimates we provide after inspecting your vehicle are valid at for 24hrs only, after which they will be considered invalid. You may be subjected to additional cost if additional faults are detected after your vehicle at the appointment. You will be notified about the additional cost first, and only upon your consent shall the repair work commence.

7. Copyright

All the material present on our site is copyrighted to us. Unauthorised use of our material for commercial purpose is strictly prohibited. You may use it to view, store, copy, and print the material on our site for the personal and non-commercial purpose only. Use of our material for commercial purpose is considered as copyright infringement and may force us to take strict actions against you such as site-access restriction, financial compensation demand, and legal proceedings.

8. Conduct

Make sure you remove all the valuable belongings from the vehicle before you leave it at our garage. We are not liable to damages caused by the loss of these valuables.

Any recommendations provided by our employee, if not stated in writing, should you choose to act on them, will be at your own risk. We are not liable to the consequences of you acting on these recommendations.

Our technicians have the right to work in a safe environment. Aggressive verbal or threatening behaviour will not be tolerated. In any circumstances where our technicians feel that they are in a situation like this, they reserve the right to refuse service and leave the appointment. No refunds will be due. Should you wish to challenge this decision all appeals must be put in writing to enquiries@simplytyres.co.uk where a manager will review the information and make a decision. This decision will be final and no further appeal will be considered.

9. Parts

If you wish to inspect the components that were detected to be faulty and were replaced, then you must notify us before we leave your our premises. If the request has not been made to us in advance, all the defective components that were removed and replaced during repairs and/or services will be considered as our property and disposed of, strictly adhering to the norms put forth by environmental regulations.

10. Payment

We accept payments for our products/services in the form of cash, debit card, credit card, or any other valid bank cards.

In case of non-payment or incomplete payment from your side after using our services, we shall claim a general lien on your vehicle. Garage rent will also be added as outstanding payment for the period your vehicle is held at our premise because of being subjected to the lien. If the unpaid bill is not fulfilled within 3 months from its date of dispatch, then we are within our rights to sell the vehicle, including its components without providing with you any prior notice. The proceeds gained from this sale shall serve as payment of your outstanding bill.

11. Guarantee claims

The OEM components, including tyres we sell on our site, are covered by manufacturer's guarantee. When you claim a guarantee on the product/service we provide, you must present the claim with an invoice that serves as a proof of purchase.

We do not provide guarantees on adjustment services such as wheel alignment and wheel balancing, as these are significantly affected by your driving behaviour and terrain condition.

Your guarantee claim may get rejected based on following grounds:

The concerned product has been damaged because of failure of adherence to manufacturer's servicing and operating instructions.

The concerned product has been damaged because of a natural calamity, theft or normal wear and tear.

The concerned product was serviced and/or repaired by another garage without our prior consent.

13. Governing law and jurisdiction

All the provisions stated on this page adhere to the UK laws and regulations. Using our website implies, unconditionally, that you consent to fall under the exclusive jurisdiction of the courts of England and Wales to settle any disputes related to your use of our website.

14. Severance

If any term defined here is deemed invalid, then another term mentioned on this page, with the intent that closely matches the intent of the original term, shall override it. Rest of the terms shall remain in effect.

15. Third-party rights

The terms stated on this page shall only be considered enforceable between you and us. No terms and conditions defined on this page can be enforced by a third-party.

Our website may contain links to third-party sites. The links to these websites are provided for the sole purpose of your reference only. We do not own the content and features present on these websites. We are not liable for any damages caused to you because of using these websites.
